LOVE ALLIANCE LLC (hereinafter, “we,” “us,” “our,” and/or “Company”) has created this Privacy Policy (this “Policy”) to describe how we may collect, use, share, and keep information about you and what choices you have.  This Policy applies to Company’s websites, services, products, content, programs, or online offerings (collectively, the “Services”).  By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, and you hereby consent that we will collect, use, and share your information in accordance with this Policy.

Your continued use of the Services is at all times subject to the Terms and Conditions, which incorporate this Policy.  Any terms not defined in this Policy shall have the same definitions given to them in the Terms and Conditions.

Company reevaluates this Policy on an ongoing basis and reserves the right to change this Policy at any time in its sole discretion.  All changes to the terms of this Policy shall be effective as of the date on which they are posted on the Services. It is your responsibility to check this page periodically for any such changes or updates.  Your continued use of or access to the Services following the posting of any changes, modifications, or updates constitutes your express acceptance thereof.

This Policy covers our treatment of information that Company gathers when you are accessing or using our Services as explained in more detail below (“Information”).

We receive and store any information you knowingly provide to us.   This Information may include, without limitation:

  • Contact information such as name, email address, mailing and/or physical address, and telephone number(s); 

  • Payment and transaction information you provide in connection with a payment or banking service, including credit or bank card information;

  • Transaction details and information related to your use of the Services, including the types of services/products you requested, any memberships subscribed for, and other related transaction details and information.

  • Preferences for communications;

  • Communications and opinions in online forms

  • Access to your geo-location or to other data held on social media platforms and other software (for example, access to your contacts, calendar, or photos);

  • Additional information as otherwise described to you at the point of collection or pursuant to your consent

  1. Information Collected Automatically

Whenever you interact with our Services, we may automatically receive and collect Information about you in order to provide a more personalized experience on the Services.  This Information may include:

  • IP Address, which is the number associated with the service through which you access the Internet, like your ISP (Internet service provider)

  • Date and time of your visit or use of our services

  • Information about Your browser and system or device configuration and capabilities

  • Your movement within the website, such as the page or feature you requested, which is aggregated with other information

  • Navigation history, including the third-party site or service you were using before and after interacting with our Services; and

  • Mobile device information, including the type of device you use, operating system version, and the device identifier (or “UDID”)

  1. Cookies & Technologies Used to Collect Information About You

Company may collect the above Information directly and through the use of third parties.  We collect this information by using cookies and other commonly used data collection technologies, such as web beacons, clear pixels, or pixel tags, web server logs, and geo-location technologies.  Third-party service providers, advertisers, and/or partners may also view, edit, or set their own cookies or place web beacons.  The use of these technologies by such third parties is subject to their own privacy policies and is not covered by this Policy, except as required by law.

  • “Cookies” (or browser cookies).  Cookies are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people.   You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.  Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our website.

  • Web Beacons. A “web beacon” (also referred to as a clear gif, pixel tag, and single-pixel gif) is an object that is embedded in a page or email and is usually invisible to the user but allows us, for example, to check whether a user has viewed the page or email, or to view other related statistics.  We also use these technical methods to analyze the traffic patterns, such as the frequency with which our users visit various parts of the Services.  These technical methods may involve the transmission of Information either directly to us or to a third party authorized by us to collect Information on our behalf.  Our Services may use retargeting pixels from Google, Facebook, and other ad networks.  We also use web beacons in HTML emails that we send to determine whether the recipients have opened those emails and/or clicked on links in those emails.

  1. Analytics. Analytics are tools we use, such as Google Analytics to help us with information about traffic to our website and use of our Services, which Google may share, including via Google Adsense, with other services and websites who use the collected data to contextual and personalize the ads of its own advertising network.

  2. Mobile Application Technologies.  If you access our website and Services through a mobile device, we may automatically collect information about your device, your phone number, and your physical location.

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites.   Our Services do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Services and after you leave our Services.

We use and process your Information for things that may include, but are not limited to, the following:

  • To create and manage your Account;

  • To fulfill a product, membership, or service order, and otherwise to fulfill contracts we have with you;

  • To respond to product and customer service requests;

  • To provide one-on-one or group coaching services or facilitate courses provided via our Services;

  • To process payments and refunds;

  • For general or targeted marketing and advertising purposes, including sending you promotional material or special offers on our behalf or on behalf of our marketing partners and/or their respective affiliates and subsidiaries and other third parties, provided that you have not already opted-out of receiving such communications;

  • To maintain, improve, customize, or administer the Services, perform business analyses, or other internal purposes to improve the quality of our business, the Services, resolve technical problems, or improve security or develop other products and services;

  • To notify you of updates to the Services, including new offerings, such as products, services, promotions, discounts, sales, sweepstakes, and contests;

  • To preventing fraudulent transactions, monitor against theft, and protect against criminal activity;

  • To comply with our Terms & Conditions;

  • For analytics for business purposes and business intelligence;

  • To comply with any applicable laws and regulations and to respond to lawful requests; and/or

  • For any other purposes disclosed to you at the time we collect your Information and/or pursuant to your consent.

  1. SHARING YOUR INFORMATION

Company does not rent or sell your Information in personally identifiable form to anyone.  We may share your Information as set forth in this Policy and with third parties as described in this section:

  1. Information that’s been de-identified.   We may de-identify your Information so that you are not identified as an individual and disclose such information without any restriction.  We may also provide aggregate usage information to our partners who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. 

  2. Third-Party Service Providers:  We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use a payment processing company, such as Paypal, Stripe, Apple Pay, and Google Pay, to receive and process your credit card transactions for us.  Unless we tell you differently, our agents do not have any right to use the Information we share with them beyond what is necessary to assist us.

  3. Business Transfers: Your Information may be transferred, sold, or otherwise conveyed (“Conveyed”) to a third party if we choose to buy or sell assets, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control.  You agree to any and all such Conveyances of your Information.

  4. Protection of Company and Others:  We may use or disclose personally-identifying information if we have a good-faith belief that the disclosure is reasonably necessary (a) to satisfy applicable law, regulation, legal process, or enforceable governmental request, (b) to enforce agreements we have with you, (c) to address fraud or security issues, or (d) to protect against harm to the rights, property, or safety of the users, or our employees.

  1. Calls 

You agree that, in order to provide the Services to you, Company and/or third party service providers with whom we collaborate, and contract may communicate with you via electronic messages, including, email, or mobile push notification, or through our alert service, which includes contacting or messaging you by telephone, email, short message service or text message.  We may communicate with you about offers, promotions, upcoming events, and other news about our Services.  Additionally, Company and its partners and affiliates may contact you at any telephone number(s) you provide in connection with your use of the Services.

You acknowledge and agree that, as part of our coaching services, we may contact you by text message, phone call, FaceTime, or other mobile application.  See Options Available to Users, below, for how you can update the way we contact you.

  1. Email. 

Company uses e-mail to send announcements regarding new products, services, and/or promotions, purchase confirmations, discounts, and for informational and marketing content and newsletters. See Options Available to Users, below, for how you can update the way we contact you.

  1. Company’s Interactive Areas

The Services may involve participation in group coaching calls attended by multiple users and other interactive services.  Company is not liable for any information posted in or shared by you as part of group coaching calls that are offered as part of the Services. DO NOT POST ANY PERSONALLY IDENTIFIABLE INFORMATION SUCH AS YOUR EMAIL ADDRESS DURING GROUP CALLS. 

  1. Links to Other Websites

Our Services may contain links to other websites or services that are not owned or controlled by us, including links to social media platforms such as Facebook, Instagram, Twitter, and YouTube, or may redirect you off our website away from our Services to other websites for information, other services, or to receive special offers, contests, games, sweepstakes, or for transactions or purchases.

For example, if you “click” on a banner advertisement, the “click” may take you off our Services and onto a different website.  This includes links from advertisers, sponsors and marketing partners that may use our website’s logo as part of a co-branding agreement.  These other websites may send their own cookies to you, independently collect data, or solicit personal Information and may or may not have their own published privacy policies.  If you visit a website that is linked to our Services, you should consult that website’s privacy policy before providing any Information.

This Privacy Policy only applies to Information collected by our Services.  We are not responsible for the privacy and security practices of those other websites or social media platforms or the Information they may collect (which may include IP address).  You should contact such third parties directly to determine their respective privacy policies.  Links to any other websites or content do not constitute or imply an endorsement or recommendation by us of the linked website, social media platform, and/or content.

  1. SECURITY

Company uses reasonable measures to provide the Services.  However, no security measures or transmissions over the internet can be 100% guaranteed to protect your information.  We do not guarantee that your Information will not be misused by other persons or institutions.  We are not responsible for the circumvention of any privacy settings or security features.  You agree that we will not have any liability for misuse, access, acquisition, deletion, or disclosure of your Information.  You have the responsibility to protect the information you provide, especially username and passwords, from misuse, whether by encryption or other means.

Your account is protected by a password for your privacy and security.  You must prevent unauthorized access to your account and Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.  We will never ask you for credit card information or personal information by email. 

If you believe that your Information has been accessed or acquired by an unauthorized person, you shall promptly contact us in accordance with the How to Contact Us section below so that necessary measures can quickly be taken.

  1. OPTIONS AVAILABLE TO USERS

  1. Email.  By using our Services, you agree that we may contact you by email as set forth herein.  If you do not want to receive marketing and promotional emails from us, you may click on the “unsubscribe” link in the email to unsubscribe and opt-out of marketing email communications or see How to Contact Us.

  2. Mobile Push Notifications.  By using our Services, you agree that we may contact you by calling or sending messages to your phone.  You can use the settings on your mobile device to enable or turn off mobile push notifications from us or see How to Contact Us.

  3. Text Messages.  By using our Services and affirmatively signing up to receive text messages, you may be reached by text message.  If you no longer want to receive text messages from us, reply STOP (or as otherwise instructed) in the text message or How to Contact Us.

  4. Location Choices.  You can change the privacy settings of your device at any time to turn off the sharing of location information with our Services.  If you choose to turn off location services, this could affect certain features or services of our Services.  If you have specific questions about the privacy settings of your device, we suggest you contact the manufacturer of your device or your mobile service provider for help.

  5. Opting Out of Direct Marketing.  To exercise choices regarding the marketing information you receive, you may also review the following links: 

  • You may opt-out of tracking and receiving tailored advertisements on your mobile device by some mobile advertising companies and other similar entities by downloading the App Choices app at www.aboutads.info/appchoices.

  • You may opt-out of receiving permissible targeted advertisements by using the NAI Opt-out tool available at http://optout.networkadvertising.org/?c=1 or visiting About Ads at https://optout.aboutads.info/?c=2&lang=EN.

  • You can opt-out of having your activity on our Services made available to Google Analytics by installing the Google Analytics opt-out add-on for your web browser by visiting: https://tools.google.com/dlpage/gaoptout for your web browser.

  1. Request for Suspension. You may request a suspension of your account by submitting a request to team@apolloniaponti.com. When you suspend your account, you will no longer receive any of our e-mails, but your profile information may remain in our records. 

  1. CONSENT TO PROCESSING AND TRANSFER OF INFORMATION

The Services is operated in the United States.  If you are located in the European Union, Canada or elsewhere outside of the United States of America, please be aware that information we collect, including your personal data, may be transferred to and processed in the United States.  By using the Services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen.

  1. ACCESSING, CORRECTING, OR DELETING YOUR INFORMATION

To the extent state laws provide users with certain data subject rights, those rights may be honored by the Company following proper authentication and verification.  Please see the How to Contact Us section below for more information.

  1. RETENTION PERIOD

Information shall be processed and stored for as long as required to provide the Services to you.  Company may be allowed to retain Information for a longer period whenever you have given consent to such processing and for as long as such consent is not withdrawn. Furthermore, Company may be obliged to retain Information for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority. Once the retention period expires, Information shall be deleted.  In accordance with our routine record keeping, we may delete certain records that contain Information you have submitted to us.  We are under no obligation to store such Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Information. 

  1. CHILDREN’S INFORMATION

Company’s Services and offerings are directed to individuals over the age of eighteen (18). They are not intended for children under thirteen (13) years of age.  Company does not knowingly solicit data online from, or market online to, children under the age of thirteen (13) years of age.  In addition, children under the age of thirteen (13) years are not permitted to submit any personal information to Company or the Services.  If we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible.  If you believe that a child under 13 may have provided us personal information, please contact us in accordance with the How to Contact Us section.
